Anna Nicole Smith could use a break. The new mom, who’s still mourning the
sudden death of her 20-year-old son, has just been hit with a paternity suit by
her ex-boyfriend.

Photographer Larry Birkhead has filed court papers demanding Smith and her
newborn daughter, Dannielynn Hope, return to California from the Bahamas to
submit to a paternity test, reports USA Today.

Birkhead’s lawyer, Debra Opri, tells the newspaper that the photographer,
“seeks truth in paternity as he believes beyond any doubt that he is the father
and seeks a presence in this child’s life. He is concerned for the health and
safety of the child based upon drug issues and manipulation by a third party for
purposes contrary to the interests of the child.”

Despite Birkhead’s paternity claims, Smith’s longtime friend and lawyer,
Howard K. Stern, announced that he was the baby’s father on last week’s Larry King Live. Smith and Stern held a marriage ceremony in the
Bahamas last week, though it wasn’t legally binding.

In an interview on MSNBC Monday night, Birkhead said that he is “outraged and
angry” over Stern’s paternity claims, and that the attorney was trying to
“hoodwink the American public” with a story full of “inconsistencies.”

“There is absolutely no way that [Stern] is the father of this child,”
Birkhead said. “He knows it, I know it and that’s all there is to it. He
challenged me on live television to get an attorney, so I have taken him up on
his offer.”

Birkhead’s lawsuit claims that Smith is a methadone user and that Stern has
been facilitating her habit. He accuses the model of going to the Bahamas to
give birth to avoid being tested for drugs

“The public will be very surprised when they learn the details of the
lifestyle this baby is going to be faced with if she remains in the current
situation,” Opri said in a statement.
